Terms of Use Rules for Using Laundry Lounge Online Services

1. Warranties

You warrant that you are of sound mind and competent to agree to the terms of this Agreement, and that your use of the App does not violate any law, regulation, ordinance, statute, or treaty applicable in the jurisdiction where you live or conduct business.

You further warrant that you are not prohibited from entering into this Agreement by any pre-existing agreement. If you access or use the App on behalf of a governmental organization, non-governmental organization, or business, you warrant that you are authorized to bind that organization to this Agreement.

2. Privacy Policy

Laundry Lounge incorporates its Privacy Policy by reference as if fully restated in this Agreement.

3. Ownership of Content and Intellectual Property

Laundry Lounge owns all rights in and to the App and its associated content, including copyright, trademark, patent, publicity and privacy rights, trade secret rights, and other property or proprietary rights.

The App is protected by United States and other applicable intellectual property laws and international treaties. Laundry Lounge provides a limited right to use the App only for its customary and intended purposes.

Laundry Lounge grants you a limited, non-exclusive, non-assignable, non-sublicensable, revocable license to use the App for its customary and intended purposes. Any rights not expressly granted are reserved to Laundry Lounge.

You may not reproduce, prepare derivative works from, distribute, publicly perform, publicly display, scrape, frame, hack, reverse engineer, crawl, or aggregate the App, in whole or in part, without prior written consent from Laundry Lounge. The restriction on crawling or aggregation does not apply to search engines that appropriately comply with Laundry Lounge’s robots.txt file.

4. Registered Accounts

Access to additional features, areas of the Website, or purchases may require registration of an account (“Account”). You may use only your own Account and may not provide others with access to it.

When registering an Account, you agree to provide accurate, complete, relevant, and current information. You are responsible for maintaining the security and confidentiality of your username and password and for activity occurring through your Account, whether authorized or unauthorized.

If you believe your Account has been accessed without authorization, you agree to notify Laundry Lounge promptly. By creating an Account, you agree that Laundry Lounge may contact you by available means, including email.

Laundry Lounge reserves the right to accept, reject, modify, suspend, or delete an Account at any time within its sole and absolute discretion.

By agreeing to these Terms of Use, a registered user agrees that Laundry Lounge may market new products and services to registered accounts.

5. Acceptable Use of App and Licenses

Users warrant that content uploaded or transmitted through Laundry Lounge is owned by the user or that the user has the appropriate rights to use the content in that manner.

Users warrant that use of the App or transmission of content through the App will not violate this Agreement, violate the rights of third parties, or violate any applicable local, state, national, or international law, statute, regulation, ordinance, or treaty.

6. Copyright Policy

The source Terms state that the Website is intended to operate as an interactive computer service for purposes of Section 230 of the Communications Decency Act and that Laundry Lounge does not become the speaker or publisher of third-party information merely by hosting, removing, suspending, changing, or amending such information.

The App is protected by copyright owned by Laundry Lounge. If user-generated content becomes available, Laundry Lounge states that it will respond to duly issued copyright infringement notices submitted pursuant to 17 U.S.C. § 512.

Copyright Infringement Notices

1. The physical or electronic signature of a person authorized to act on behalf of the copyright owner.
2. Specific identification of the copyrighted works alleged to have been infringed.
3. The location of the allegedly infringing material on the Website.
4. Contact information for the notifying person, such as an address, telephone number, fax number, or email address.
5. A statement that the notifying person has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information in the notice is accurate and that the notifying person is authorized to act on behalf of the copyright owner.

Counter-Notifications

1. Identification of the specific material that was removed.
2. Contact information for the notifying person.
3. A statement, under penalty of perjury, that the material was removed because of mistake or misidentification.
4. A statement consenting to the jurisdiction described in the source Terms.
5. A statement agreeing to accept service of process from the notified party.
6. The physical or electronic signature of the person submitting the counter-notification.

7. Indemnification

Users agree to hold harmless, defend, and indemnify Laundry Lounge from and against claims, demands, judgments, liabilities, costs, and fees, including attorneys’ fees, arising out of or related to account creation or use, user-generated content, violations of this Agreement, violations of third-party rights, or violations of applicable law.

A user’s obligation to defend Laundry Lounge does not provide the user with the right to control Laundry Lounge’s defense. Laundry Lounge reserves the right to control its defense, including decisions regarding litigation, settlement, and choice of counsel.

8. Control of Operations

Laundry Lounge reserves the right to accept, reject, modify, suspend, or delete a user or user-generated content at any time and within its sole and absolute discretion. Laundry Lounge also reserves the right to modify or discontinue the App or associated services at any time, without notice and within its sole and absolute discretion.

9. Laundry Lounge as Service Provider

The source Terms describe Laundry Lounge as providing an App service and state that Laundry Lounge does not accept responsibility for communications or conduct entered into by users of the App.

The source Terms further state that Laundry Lounge makes no representations or warranties as to the truth or falsity of a user’s communications or representations, or as to the legality, quality, safety, title, non-infringement, or qualifications associated with an account, product, or service.

10. Acceptable Uses

You agree not to use the App to violate any law, statute, ordinance, regulation, or treaty, to violate the rights of third parties, or for uses outside the customary and intended purposes of the App.

Specifically, you may not:

1. Transmit unsolicited commercial email through the App or to users of the App.
2. Impose a disproportionate load on the App or its server infrastructure or interfere with App operation.
3. Circumvent Laundry Lounge technological or security protection mechanisms.
4. Use a robot, spider, scraper, or other automated technology to access the App.
5. Attempt to gain access to private data or personal information belonging to users or third parties.
6. Post or transmit content intended to collect personal or personally identifiable information from users or third parties.
7. Harass users of the App.
8. Harass third parties through use of the App.
9. Post or transmit content that threatens or encourages bodily harm or destruction of property.
10. Post or transmit content that infringes intellectual property rights.
11. Post or transmit fraudulent content, unwanted commercial solicitations, phishing scams, pyramid schemes, or chain letters.
12. Post or transmit content in violation of 18 U.S.C. § 2257.

11. Payment

The source Terms describe Laundry Lounge as a platform marketing laundry services, including wash-and-fold services. Users may place an order and pay by credit card or another approved financial instrument. Laundry may then be picked up or deposited at a designated physical location, depending on the service. Receipts may be generated electronically.

The source Terms state that payments for services, products, information, or other offerings through the App are non-refundable and authorize the payment processing agent to charge the approved payment method according to the billing policy displayed in the App.

Users agree to pay fees and charges when due. Laundry Lounge may terminate or disable access to the App or an Account for unpaid amounts and may seek collection costs, including legal fees, as described in the source Terms.

Users are responsible for applicable taxes and charges connected with use of the App. Fees are quoted and payable in United States Dollars. The source Terms also address foreign transaction fees, payment disputes, chargebacks, and notice requirements for disputed payments.

12. Third-Party Links

The App may contain links to third-party websites not owned or controlled by Laundry Lounge. Laundry Lounge is not responsible for third-party website content, and users are advised to review the terms of use and privacy policies of those websites.

13. Term and Termination

This Agreement remains in effect until terminated under its terms. The source Terms state that users may terminate a subscription by notifying Laundry Lounge in a signed writing stating the intent to terminate.

Laundry Lounge may terminate this Agreement without liability, without notice, and for any reason, including a violation of a term or condition of this Agreement.

14. Disclaimer of Warranties

The source Terms provide the App on an “as-is” basis and disclaim express and implied warranties, including warranties of merchantability, fitness for a particular purpose, quality, title, accuracy, and non-infringement, subject to applicable law.

15. Limitation of Liability

The source Terms limit Laundry Lounge’s liability for claims, damages, judgments, liabilities, costs, charges, and fees, including indirect, consequential, exemplary, incidental, statutory, special, and punitive damages, to the extent permitted by law.

The source Terms also state that Laundry Lounge is not responsible for user-posted content or certain errors, omissions, interruptions, deletion, defects, unauthorized account access, or alteration, and reserves the right to discontinue the Website without liability.

16. Indemnification

You agree to hold harmless, indemnify, and defend Laundry Lounge, its officers, employees, agents, successors, and assigns from claims, demands, losses, damages, rights, and actions arising directly or indirectly from use of the App, registration or use of an Account, user-generated content, violations of this Agreement, violations of law, or violations of third-party rights.

The source Terms reserve to Laundry Lounge the right to control its defense and choose its counsel regardless of a user’s contractual obligation to defend Laundry Lounge.

17. Assignment

You may not assign your rights or obligations under this Agreement. Laundry Lounge may assign its rights and obligations under this Agreement, including in connection with a sale of the App.

18. Choice of Laws

The source Terms state that this Agreement is governed by the laws of the State of California and that claims or disputes must be resolved by a court located in Los Angeles County, California, with the parties submitting to personal jurisdiction there.

19. Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will remain valid and unimpaired and will continue in full force and effect.

20. Integration

This Agreement and its incorporated Privacy and Copyright policies constitute the entire agreement between the parties with respect to use of the App and its associated services.

21. Waiver

No term or provision of this Agreement will be considered waived, and no breach will be considered consented to, unless the waiver or consent is in writing and signed by the party to be charged.

22. Limitation on Actions

The source Terms state that any cause of action arising out of or related to the App must commence within one year after the cause of action accrues, and that failure to assert the cause of action within that period will bar relief.

23. Reservation of Rights

All rights not expressly granted in this Agreement are reserved to Laundry Lounge.
